DISTANCE SALES AGREEMENT

1. PARTIES

This Agreement has been signed between the parties listed below under the terms and conditions specified herein.

B. "SELLER" (hereinafter referred to as "SELLER" in this Agreement)

By accepting this Agreement, the BUYER acknowledges and agrees that, upon confirmation of the order, they are obligated to pay the price of the order, including any additional costs such as shipping fees and taxes if applicable.

2. DEFINITIONS

In the interpretation and application of this Agreement, the following terms shall have the meanings set forth below:

• MINISTER: The Minister of Customs and Trade.
• MINISTRY: The Ministry of Customs and Trade.
• LAW: The Consumer Protection Law No. 6502.
• REGULATION: The Distance Contracts Regulation (Official Gazette: 27.11.2014/29188).
• SERVICE: Any consumer transaction other than the supply of goods, carried out in exchange for a fee or benefit.
• SELLER: The company offering goods to consumers as part of its commercial or professional activities or acting on behalf of or for the account of the supplier.
• BUYER: A real or legal person who purchases, uses, or benefits from a good or service for non-commercial or non-professional purposes.
• SITE: The website owned by the SELLER.
• ORDER PLACER: The real or legal person who places an order for a good or service through the SELLER’s website.
• PARTIES: The SELLER and the BUYER.
• AGREEMENT: This Distance Sales Agreement concluded between the SELLER and the BUYER.
• GOODS: The tangible movable property subject to shopping and intangible goods prepared for use in electronic environments, such as software, sound, images, etc.

3. SUBJECT

This Agreement sets forth the rights and obligations of the PARTIES in accordance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation regarding the sale and delivery of the product(s) ordered by the BUYER from the SELLER's website.

The prices listed and announced on the site are the sales prices. The announced prices and promises remain valid until updated and changed. Temporarily announced prices are valid until the stated expiration date.

If a campaign has been organized by the SELLER, you can review the relevant product’s basic features during the campaign period. Campaigns remain valid until the stated expiration date.

• The invoice will be delivered along with the order to the invoice address provided at the time of purchase.

GENERAL TERMS

1. The BUYER acknowledges and agrees that they have read and understood all the preliminary information regarding the product’s basic features, sales price, payment method, and delivery details on the SELLER's website and has given electronic confirmation.
2. Each product covered by this Agreement shall be delivered to the BUYER or the recipient designated by the BUYER within 30 days, depending on the BUYER's location, as stated in the pre-information section of the website.
3. If the SELLER is unable to deliver the product within the specified period due to force majeure or unforeseen circumstances, the BUYER may choose to:
   • Cancel the order.
   • Replace it with an equivalent product.
   • Postpone the delivery until the obstacle is removed.

RIGHT OF WITHDRAWAL

1. The BUYER may return the purchased product within 14 days of receipt without any justification or penalty, provided that they notify the SELLER in writing.
2. The right of withdrawal does not apply to:
   • Personalized or customized products.
   • Undergarments, swimsuits, and similar hygiene-related products if unsealed.
   • Digital goods, books, and software once opened.
   • Perishable or quickly expiring items.

For the return process, the product must be returned in its original condition, along with the invoice, return form, and all accessories. The SELLER must process the refund within 14 days of receiving the return request.

DEFAULT AND LEGAL CONSEQUENCES

• If the BUYER defaults on credit card payments, they acknowledge they will be responsible for any interest and legal obligations arising from their contract with their bank.
• In such cases, the bank may take legal action, and the BUYER agrees to cover any legal and administrative costs.

COMPETENT COURT

• Disputes arising from this Agreement shall be resolved through Consumer Arbitration Committees or Consumer Courts within the jurisdiction of the BUYER’s location, subject to monetary limits established by the Consumer Protection Law.

EFFECTIVE DATE

By making a payment for the order, the BUYER is deemed to have accepted all terms of this Agreement. The SELLER is responsible for ensuring the BUYER reads and confirms this Agreement before finalizing the order.
